The Pharmuni website located on www.Pharmuni.com (“Site”) and the Pharmuni Mobile Applications (“App”) available on Apple App Store (IOS) and Google Play Store (Android), are owned and operated by Zamann Pharma Support GmbH from Germany. Throughout the Site, the terms “we”, “us”, “platform”, “Pharmuni”, and “our” refer to Zamann Pharma Support GmbH. We offer the Pharmuni Site and App (collectively referred to as “Site”), including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us (“User” or “Client” or “Student”), you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, Clients, and/ or contributors of content.

PLEASE READ THE FOLLOWING TERMS AND DISCLAIMERS CAREFULLY BEFORE USING THE SERVICES. IF YOU DO NOT AGREE WITH THESE TERMS, OUR PRIVACY POLICY, OR ANY OTHER OF OUR POLICY, YOU SHOULD NOT USE THE SERVICES.

2. Pharmuni General Information

2.1 About

Pharmuni is an E-learning platform that delivers e-learning lectures, courses, and job qualification programs. To find out more information about what we do, please refer to our website.

2.2 No Guarantee.

We expect you to confirm that the Lectures, Courses and Job Qualification Programmes you are purchasing in will meet your needs. We do not make any guarantee to you that you will obtain a particular result, professional qualification, or employment opportunity from your purchase and completion of any of the Services.

2.3 Sole discretion.

We reserve the right to vary or withdraw any of our Services without notice.

3. Eligibility

Pharmuni is strictly limited to parties who can lawfully enter and form contracts on the Internet. If you are under age 18, you may only use the Services with the consent of your parent or legal guardian. Please be sure your parent or legal guardian has reviewed and discussed these Terms with you.

4. App Updates and Functionality

From time to time, updates to the App may be made available through the App Store and Play Store. Depending on the update, and whether you utilized the App Store or Play Store to download and access the App, you may not be able to use the App until you have installed the latest version. In addition, you acknowledge that the App is provided over the Internet and mobile networks and so the quality and availability of the App may be affected by factors outside our reasonable control. Accordingly, we do not accept any responsibility for any connectivity issues that you may experience when using the App. In addition, you acknowledge and agree that you (and not us) are responsible for obtaining and maintaining all telecommunications, broadband and computer hardware, equipment and services needed to access and use the App, and for paying any data charges that may be charged to you by your network provider in connection with your use of the App.

5. Store Rules

With respect to downloading the App, you agree to comply with the App Store Rules and Play Store Rules, as applicable. You acknowledge that the availability of the App may be dependent on the App Store or Play Store from which you receive the App. You acknowledge these Terms are between you and Pharmuni and not with the App Store or Play Store. The App Store and Play Store are not responsible for the App, the content thereof, maintenance, support services, and warranty therefore, and addressing any claims relating thereto (e.g., product liability, legal compliance, or intellectual property infringement). You acknowledge that the App Store and Play Store (and their respective subsidiaries) are third party beneficiaries to these Terms and will have the right to enforce these Terms against you.

6. Pricing

You agree to pay the fees for content or job postings that you purchase including any subscription plans, and you authorize us to charge your debit or credit card or process other means of payment (such as Boleto, SEPA, direct debit, or mobile wallet) for those fees.

Pharmuni works with payment service providers such as “Stripe” to offer you the most convenient payment methods in your country and to keep your payment information secure. We may update your payment methods using information provided by our payment service providers. Check out our Privacy Policy for more details.

When you make a purchase, you agree not to use an invalid or unauthorized payment method.

We may also be required to add taxes to your purchase fee based on your region. If your payment was not successful Pharmuni has the right to revoke the access to any Pharmuni content or features. We reserve the right to change our pricing for our service as our own discretion.

7. Payments

You agree to pay the fees for content that you purchase, and you authorize us to charge your debit or credit card or process other means of payment (such as Boleto, SEPA, direct debit, or mobile wallet) for those fees. Pharmuni works with payment service providers such as “Stripe” to offer you the most convenient payment methods in your country and to keep your payment information secure. We may update your payment methods using information provided by our payment service providers. Check out our Privacy Policy for more details.

When you make a purchase, you agree not to use an invalid or unauthorized payment method. If your payment method fails and you still get access to the content you are enrolling in, you agree to pay us the corresponding fees within thirty (30) days of notification from us. We reserve the right to disable access to any content for which we have not received adequate payment.

Cost to access content is shown at the time of your purchase. We may also be required to add taxes to your purchase fee based on your region. If your payment was not successful Pharmuni hast the right to revoke the access to any Pharmuni content. We reserve the right to change our pricing for our service as our own degression. Any price changes will take a effect we will email you first.

8. Delinquent Accounts

Pharmuni may suspend or terminate access to the Service, including fee-based portions of the Service, for any Account for which any amount is due but unpaid. In addition to the amount due for the Service, a Delinquent Account will be charged with fees or charges that are incidental to any chargeback or collection of any unpaid amount, including collection fees.

If your payment method is not valid at the time a Subscription Fee is due and you do not resolve the issues with payment during any applicable grace period that may be provided by Pharmuni, then Pharmuni reserves the right to suspend your subscription to the applicable Subscription Offering(s) and (i) unenroll you entirely from all applicable Offering(s) within such Subscription Offering, which may result in you losing any progress you made in such Offering(s), to the extent you opt to re-enroll in the Offering via subscription or otherwise or (ii) change your enrollment in such Offering(s).

9. Permitted use

You agree to use the Site and the Services only for purposes that are permitted by these Terms and Conditions in compliance with all applicable laws, regulations, and generally accepted practices or guidelines in the relevant jurisdictions. You may only use the Site and Services for your non-commercial, non-exclusive, non-assignable, non-transferable, and limited personal use, and no other purposes.

You will not (and will not attempt to):

1.1. Access any of the Services by any means other than through the interface that is provided by Pharmuni;

1.2. Gain unauthorized access to Pharmuni’s computer system or engage in any activity that interferes with the performance of, or impairs the functionality or security of the Site, the Services, Pharmuni’s networks, and computer systems;

1.3. Access any of the Site or the Services through any automated means or with any automated features or devices (including use of scripts or web crawlers);

1.4. Access or collect any personally identifiable information, including any names, email addresses, or other such information for any purpose, including, without limitation, commercial purposes;

1.5. Reproduce, duplicate, copy, sell, trade, or resell any aspect of the Site or the Services for any purpose; and

1.6. Reproduce, duplicate, copy, sell, trade, or resell any products or services bearing any trademark, service mark, trade name, logo, or service mark owned by Pharmuni in a way that is likely or intended to confuse the owner or authorized user of such marks, names or logos.

10. Content Versioning

If an update is required to our content, and if the user hasn’t finished the content, they are moved to new version automatically.

11. Access time limitation

The length of time we grant access to Pharmuni content is at the discretion of Pharmuni. Should a user require an updated certificate they will need to retake the course module and quiz again. Certificates have a expiry date of (2 years from time given out). University partners will have a specific time limit based on an individual contracted agreement. Pharmuni reserves right to change time limitation for access on our product. If you cancel your subscription plan you no longer have access to the course content or application features included in the plan. This includes if you have started a course and not yet completed it.

12. Responsibility

For any of the Pharmuni course, content, learning material, advice, or information Pharmuni provides, the Client has sole responsibility for any decisions they may make following coaching with Pharmuni. Remarkable results can be achieved where clients follow a clear plan in a committed way. Pharmuni accepts no liability for the Client’s actions and offers no guarantees for a result. Pharmuni has no liability for any loss incurred by any Client, whether financial or otherwise, following commencement of learning or based on any advice or documentation given by Pharmuni whether justified or otherwise, to achieve a material improvement in the quality of life or to achieve their desired outcomes or goals.

13. Subscription Offerings

This Section sets forth additional terms that apply to your use of our Subscription Offerings (as defined below). By subscribing to a Subscription Offering, you agree to the additional terms in this Section.

The Service may include certain subscription-based plans with automatically recurring payments for periodic charges, which enable subscribers to access the Offerings included within such plan (each, a “Subscription Offering”).

Your paid subscription to a Subscription Offering will begin on the date when you first purchase your subscription (the “Subscription Billing Date”) and continue for the duration of the subscription period (such period, the “Initial Subscription Period”), and will automatically renew for successive periods of the same duration as the Initial Subscription Period (the Initial Subscription Period and each such renewal period, each a “Subscription Period”), unless you cancel your subscription or we terminate your subscription or the Subscription Offering.

If you subscribe to a Subscription Offering, then you authorize Pharmuni or its third-party payment processors to periodically charge, on a going-forward basis and until your cancellation or our termination of your subscription or the Subscription Offering, all sums that have accrued on or before the payment due date. For each Subscription Offering to which you are subscribed, your Account will be charged automatically on the Subscription Billing Date and thereafter on the renewal date of your subscription for all applicable Subscription Fees for the next Subscription Period. Pharmuni or its third-party payment processor will bill such charges to the payment method associated with your Account or that you otherwise provide to us. You will promptly update your Account information with any changes to your payment method (for example, a change in your billing address or credit card expiration date) that may occur.

14. Cancellation of Subscription Plans

Pharmuni users may cancel their subscription plan at any time.

Pharmuni is unable to provide refunds for our Subscription Plans, unless otherwise required by applicable law. YOUR CANCELLATION MUST BE RECEIVED BEFORE THE RENEWAL DATE IN ORDER TO AVOID THE CHARGE FOR THE NEXT SUBSCRIPTION PERIOD. FOR SUBSCRIPTION OFFERINGS WITH A FREE TRIAL PERIOD, YOUR CANCELLATION MUST BE RECEIVED BEFORE THE END OF THE FREE TRIAL PERIOD IN ORDER TO AVOID THE INITIAL SUBSCRIPTION FEE.

15. How to cancel your subscription

Go to your account in Pharmuni, and click on your Account information. Then go to the subscription section where you can cancel through the Cancel Subscription button. Follow the prompts to cancel your subscription.

16. Subscription Plan Refunds

Pharmuni is unable to provide refunds for our Subscription Plans, unless otherwise required by applicable law. The below information outlines Pharmuni’s policies related to honouring refunds when required by applicable law, including requirements to submit a refund request.

17. Subscription Plan Refund Exceptions Due to Applicable Law

Pharmuni is unable to provide refunds for our Subscription Plans, unless otherwise required by applicable law.

Depending on where you are located, you may be eligible for a subscription refund within a specific number of days (your “refund period”). We determine your location based on the country associated with your Pharmuni account.

For learners with Pharmuni accounts in countries/regions where subscription refunds are required by law, Pharmuni will honor subscription refund requests, so long as requests are made within the country-specific refund periods. Examples of such countries/regions include the following:

18. How to submit a refund request

If you are in a country/region where you are entitled to a refund and would like to receive such refund, you may cancel your subscription and submit a refund request to info@pharmuni.com before your applicable refund period concludes.

Please note that requesting a subscription refund will result in cancellation of your Subscription Plan and your access to that Subscription Plan will automatically end on the last day of your billing period.

If you are in a country/region and you submit your refund request outside of the applicable refund period, the subscription will be cancelled and no refund will be applied.

19. Other reasons for refusing a refund

We reserve the right, at our sole discretion, to limit or refuse any reimbursement requests if, in our opinion, they are being misused, for example in the following cases:

19.1 The participant has requested multiple refunds for the same plan.

19.2 The user requested excessive refunds.

19.3 The user’s account or course access has been blocked due to a violation of our Terms and Conditions.

These reimbursement restrictions will be enforced to the fullest extent permitted by law.

20. Limited License and Site Access; Acceptable Use

You may not: (a) resell or make any commercial use of this Site or any of the contents of this Site; (b) modify, adapt, translate, reverse engineer, decompile, disassemble or convert any of the contents of this Site not intended to be so read; (c) copy, imitate, mirror, reproduce, distribute, publish, download, display, perform, post or transmit any of the contents of this Site in any form or by any means; or (d) use any data mining, bots, spiders, automated tools or similar data gathering and extraction methods on the contents of the Site or to collect any information from the Site or any other user of the Site.

You use this Site at your own risk. You agree that you will be personally responsible for your use of this Site and all of your communication and activity on this Site. If we determine, in our sole discretion, that you engaged in prohibited activities, were not respectful of other users, or otherwise violated the Terms and Conditions, we may deny you access to this Site on a temporary or permanent basis and any decision to do so is final.

21. Accounts, Registrations, and Passwords

If you use this Site and such use requires setting up an account and/or password(s), you are solely responsible for maintaining the confidentiality of your account and password(s) and for restricting access to your computer. If you open an account, register, or otherwise provide us with any information, you agree to provide us with current, complete, and accurate information as requested by any forms. Pharmuni is not responsible for any errors or delays in responding to any inquiry or request caused by any outdated or incorrect information provided by you or any technical problems beyond the control of Pharmuni. You acknowledge and agree that any login, identifier, or password issued in connection with this Site (each a “Password”) is confidential information and must be kept secure. You may not disclose such a Password to another person or entity or permit another entity to access the Site using such a Password. You must notify Pharmuni immediately of any breach of security or unauthorized use of your account. Pharmuni cannot be responsible and disclaims all liability in connection with, the use of any information that you post or display on this Site.

22. Promotional Codes

Pharmuni or our partners may provide promotional codes to Users at their discretion. Certain codes may be redeemed and applied to your Pharmuni account, which then may be used to purchase subscription plans on our platform, subject to the terms included with the code. Promotional codes offered by Pharmuni may not be refunded for cash. Promotional codes offered by a partner are subject to that partner’s refund policies. Codes cannot be used as a credit on Pharmuni account.

23. Content and Behavior Rules

You may not access or use the Services or create an account for unlawful purposes. Your use of the Services and behavior on our platform must comply with applicable local or national laws or regulations of your country. You are solely responsible for the knowledge of and compliance with such laws and regulations that are applicable to you.

24. Certificates

If you are a user of Pharmuni the services enable you receive certificate. User must meet the past mark of a minimum 80% to receive the certificate.

Should a User successfully complete our content and pass the required quizzes, they can receive a certificate for the completed content. The certificates do not provide the student with any guarantee to you that you will obtain employment opportunity from your purchase and completion of any of the Services.

All Pharmuni certificates are provided by Zamann Pharma Support GmbH who are ISO9001:2015 certified, including the qualification of personnel in Pharmacy, Medical Technology and Quality Assurance. TÜV-SÜD Zertifikat-Registrier-Nr.. 12 100 60610 TMS. Zamann Pharma Support GmbH and Pharmuni are not a state registered training organisation.

25. Copyright & Trademarks

The Pharmuni website contains materials including, but not limited to, text, images, designs, photographs, videos, audio clips, graphics, button icons, pictures, advertising copy, URLs, technology, software, and the overall arrangement or “look and feel” of such materials including copyrightable material, as well as trademarks, logos, and service marks that belong to either Pharmuni, its licensors, licensees or other third parties (collectively the “Content”). The Website and the Content are owned, licensed, or controlled by Zamann Pharma Support GmbH (referred to as “Pharmuni”), its licensors, and certain other third parties, and all right, title, interest in and to the Content and the Website are the property of Pharmuni, its licensors, or certain other third parties and are protected by Germany and international copyright, trademark, trade dress, patent or other intellectual property rights and laws to the fullest extent possible. Content relating to Pharmuni course or any learning material provided through Pharmuni or Zamann Pharma Support GmbH, is created by and owned solely by Zamann Pharma Support GmbH (referred to as “Pharmuni”). By using the Website, you will not obtain any ownership or intellectual property or other interest in any item or content on the Website. Subject to your agreement and compliance with this Agreement, Pharmuni grants you a limited, non-exclusive, non-transferrable, non-assignable, revocable license to access, display, view, and use the Content on the Website for your own personal, non-commercial use only. You agree that Pharmuni may immediately and, without notice to you, suspend or terminate the availability of the Website, its Content, or the Products without any liability to you or any third party.

Access to and use of this website, as well as websites related or connected to this by links, are at the user’s own risk and responsibility. Damage and warranty claims arising from missing or incorrect data are excluded. Pharmuni bears no responsibility or liability for damage of any kind, also for indirect or consequential damages resulting from access to or use of this website or websites related or connected to this by links.

All content shown on Pharmuni platform, design, text, imagery, voice over or anything that makes up Pharmuni product under copyright ownership of Pharmuni and Zamann Pharma Support GmbH. Pharmuni reserves right to seek legal advice and action should copyright infringement be identified.

31. Pharmunis’ Rights

All right, title, and interest in and to the Pharmuni platform and Services, including our website, our existing or future applications, our APIs, databases, and the content provided through our service is and will remain exclusive property of Pharmuni and its licenses. Our platforms and services are protected by copyright, trademark, and other laws of both the European countries and foreign countries. Nothing gives you a right to use the Pharmuni name or any of the Pharmuni trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding Pharmuni or the Services is entirely voluntary and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.

31.1 You may not do any of the following while accessing or using the Pharmuni platform and Services:

31.2 Access, tamper with, or use non-public areas of the platform (including content storage), Pharmuni computer systems, or the technical delivery systems of Pharmuni service providers.

31.3 Disable, interfere with, or try to circumvent any of the features of the platforms related to security or probe, scan, or test the vulnerability of any of our systems.

31.4 Copy, modify, create a derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code of or content on the Pharmuni platform or Services.

31.5 Access or search or attempt to access or search our platform by any means (automated or otherwise) other than through our currently available search functionalities that are provided via our website, mobile apps, or API (and only pursuant to those API terms and conditions). You may not scrape, spider, use a robot, or use other automated means of any kind to access the Services.

31.6 In any way use the Services to send altered, deceptive, or false source-identifying information (such as sending email communications falsely appearing as Pharmuni); or interfere with, or disrupt, (or attempt to do so), the access of any user, host, or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the platforms or services, or in any other manner interfering with or creating an undue burden on the Services.

32. Account Management

You have right to cancel your account at any time and on cancellation you may be entitled to refund if it meets our refund policy. Your access to the content may start with a free trial. The duration of the free trial period of your account will be determined by Pharmuni. Pharmuni determines free trial eligibility at our sole discretion and may limit eligibility or duration. We reserve the right to terminate the free trial and suspend your access if we determine that you are not eligible.

33. Binding Agreement

You agree that by registering, accessing, or using our Services, you are agreeing to enter into a legally binding contract with Pharmuni. If you do not agree to these Terms, do not register, access, or otherwise use any of our Services.

Any version of these Terms in a language other than English is provided for convenience and you understand and agree that the English language will control if there is any conflict.

These Terms (including any agreements and policies linked from these Terms) constitute the entire agreement between you and us.

If any part of these Terms is found to be invalid or unenforceable by applicable law, then that provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms will continue in effect.

Even if we are delayed in exercising our rights or fail to exercise a right in one case, it doesn’t mean we waive our rights under these Terms, and we may decide to enforce them in the future. If we decide to waive any of our rights in a particular instance, it doesn’t mean we waive our rights generally or in the future.

34. Legal Actions and Notices

Any legal action related to this Agreement must be initiated within one year from the time the event causing the action occurred, except where this limitation cannot be imposed by law. Any notice or communication related to this Agreement must be in writing.
